Its is a new amendment to the Evidence Act 1950 that passed in parliament states that any owner, administrator, host editor, subscriber of a network or website, or owner of a computer or mobile device is presumed to have published or re-published its contents.
this law will impact anyone who uses the internet, computers, or mobile devices - which means just about everyone, from individual users to business.
How does ACT114A affect you?
I will lost my freedom of using the internet. Instead, I will be affected by awareness and worrying about every single action i have done in the internet to prevent any content posted against the law. The government says the point of the law is to prevent online bullying, somehow yes it is. But i don't think it will protect us, but getting us suffering from oppression of using the internet.
Does it really matter?
Of cause it does matter, not only adults, even small kids who use internet or use mobile devices are possible to deemed guilty under the ACT114A. There are few example how they works:
1. One could even be held accountable for information posted on an account that had been hacked
2. Someone creates an random name to posts or what ever they done are against the law
3. Anonymous comment left via free WIFI available in cafes
all of this example are possible to deemed guilty until they prove themselves innocent. But, who are the one that actually deemed guilty? not the one who posted it, but the one that user account had been hacked, the random name user which had been used, and lastly the WIFI hosting owner will be caught. Is this what the government wants to do, charging the innocent people around? Furthermore, what if the victim are just a child, could them able to prove themselves innocent?
Should you be concerned?
I will definitely concern about what it is happening, because i am one of the internet user as well. I dont think this ACT work that well, it works oppositely. This will only let the hacker being aware of using their own name or IP address, therefore they will either creates an fake account by using others people name or take advantage by using others people internet or WIFI service. So that they could able to get rid of charge under the ACT114A.
I think there is still a lot of improvement against this law, especially who is the right person should be deemed guilty, somemore I don't think this really can fully protect us in cases of online bully, It just made us more afraid of freedom of speaking in network

yes improvement is good, but i feel it is better that the ACT114A itself should be banned. I dont find any benefits out of it to be continue. For your information, many of the internet users have started to vote online for repelling and stopping the action of ACT114A.

ReplyDeleteYes,it is so innocent for the victim who is just a child as he/she can't prove himself and his/her parents will be involved in the case too. I strongly agree with your sentence which is 'I dont think this ACT work that well, it works oppositely.'. The section might help a lot of criminals get out from the accusation but involve many innocent person. I think the section should have improvement or just banned.
ReplyDeleteyea, in this new era, most of the children are influence by media technology. This is so dangerous that the government should make sure that they inform every single of us clearly so that we could able to be aware of it.
DeleteYes, I am one of you guys. I agree with that. Act114A should be improve in order to launch it. It should be make it more clear as many people will involve this law anytime, anywhere where got internet usage.
